Now Published: SCL(S) Protocol for the Use of Experts’ Joint Statements in Arbitration

Dear Friends, Colleagues and fellow members of the Society of Construction Law (Singapore) (SCL(S)),
One of the objectives of SCL(S) is to seek to contribute to the education, study and research in the field of construction law and related subjects, for the benefit of our friends, colleagues and other stakeholders in the construction industry and built environment sector.
A working group of the SCL(S) Thought Leadership committee was formed to draft the Protocol for the Use of Experts’ Joint Statements in Arbitration (Protocol). In 2024, an eminent panel at the SCL(S) Annual Conference was invited to provide comments to the draft Protocol. In 2025, SCL(S) invited members, and other stakeholder individuals, organisations and institutions to provide further comments. The working group has carefully reviewed the feedback and incorporated it where appropriate.
SCL (Singapore) has finalised, and published the Protocol and it is now available for download at the Protocols section of our website: 👉 https://scl.org.sg/public-resources/protocols.html.
Why this Protocol?
Expert evidence is a cornerstone of construction dispute resolution. This Protocol is designed to be a practical benchmark for best practices, focusing on:
- Procedural Clarity: Streamlining the interaction between experts.
- Efficiency: Reducing time and costs associated with expert evidence.
- Collaboration: Enhancing the quality of joint statements to assist tribunals.
Foreword
We have had the honour of having a foreword written for us by Justice Philip Jeyaretnam, President of the Singapore International Commercial Court and Judge of the High Court. Justice Jeyaretnam commended the Protocol as being reflective of both international best practice and the distinctive strengths of our construction and arbitration community. In his view, the Protocol will contribute significantly to the quality of expert evidence in Singapore-seated arbitrations and beyond.
A note of our sincere appreciation
We would like to extend our sincere appreciation to everyone who contributed their time and insights during the feedback period. Your expertise has been instrumental in ensuring this Protocol is robust, practical, and fit for purpose.
We look forward to further serving the members of the SCL(S).
Before closing, we would like to mention that following its launch on 28 January, the Protocol will be further discussed at an upcoming APIEx Seminar “Reimagining Expert Evidence in Construction Disputes - Protocols, Practice and Perspectives” on 27 February 2026 in Kuala Lumpur.
Thank you for your continued support.
Warm regards,
The Secretariat on behalf of
Society of Construction Law (Singapore)
