1. The Building and Construction Industry Security of Payment Act (Cap. 30B, 2006 Revised Edition) (“the Act”) is a relatively new piece of legislation, applying only to contracts in the building and construction industry made in writing on or after 1 April 2005. The Act aims to facilitate payments for construction work done or for related goods and services supplied in the building and construction industry.

1. The statutory adjudication procedure in the construction industry is “a primary means of dispute resolution”1 in numerous common law jurisdictions. In Chip Hup Hup Kee Construction Pte Ltd v Ssangyong Engineering & Construction Co Ltd,2 Judith Prakash J noted that the Singapore Building and Construction Industry Security of Payment Act is based on the New South Wales Building and Construction Industry Security of Payment Act 1999.
